Injunction Lifted
". . . Consequently, the court lifts the preliminary injunction, thereby allowing the state of Utah to enforce the 'Partial Birth Abortion Amendments.' The court dismisses this case with prejudice. The Clerk’s Office is directed to close this case."
Utah’s Partial Birth Abortion statute has been frozen since 2004. In light of the recent Supreme Court decision in Gonzales v. Carhart (which found an almost identical federal law to be constitutional), Utah’s federal district court lifted the injunction on Utah’s law and dismissed the case that challenged it. Bottom line: Utah's partial-birth abortion ban statute may now be enforced.

Could I please get some information here? I talk to some of you anti-mom pro abortion chicks at school and more often than not you girls are also against the death penalty as a crime deterrent and/or form of justice. Why? Correct me if I am wrong but the death of an innocent at nine months doesn't seem to trouble your sensitivities. Why would the extermination of a guilty or innocent party on death row cause you discomfort? True justice is the last thing you care about. Somebody else would take the child after you placed the order and changed you mind but you would rather commit infanticide and spare the life of someone who like you has taken innocent life. Perhaps your justifying your position. Just Wondering!
